Attorney Richard S. Stern Published Appellate Verdicts
Here are some representative cases that demonstrate my substantial history of litigation.
- Case in the District Court for the District of Columbia: the trial court dismissed the indictment for lack of speedy trial
- Conviction for threats to president case reversed: the trial court lacked jurisdiction
- U.S. District Court for the District of Columbia: successful defense against felony at trial—indictment dismissed for prosecutorial misconduct in adding charges
- U.S. Court of Appeals: primary decision on the admissibility of ATM photographs
- Civil case in the D.C. Court of Appeals: the court affirmed the trial court in entering a default for failure to cooperate in discovery
- District of Columbia Court of Appeals: the court defined assault where no physical contact had occurred
- U.S. Court of Appeals for the District of Columbia: conviction reversed where the trial court had admitted evidence of the nature of the neighborhood in assault on federal officer case (over the objection of counsel)
Civil matters have also included representing a computer company that had to litigate against another programming company that it hired to develop computer interfaces. The company being sued had developed a worthless program that contained hundreds of thousands of lines of code, but we called an expert who found that all the programming that was billed at astronomical rates was simply library that one can simply cut and paste from the internet. The jury returned a six figure verdict. Others cases have involved corporations who have purposely diluted stock (issued additional shares to give the minority shareholders a lower and lower percentage) to cheat minority shareholders.
